The Adjudicator DECIDED to impose the following immediate condition on the current (2009/2010) practising certificate of Mrs Rose Ifeoma Akutu pursuant to Section 13A of the Solicitors Act 1974 (as amended) and Regulation 6 of the SRA Practising Regulations 2009:

1. that if she holds client money she delivers half yearly accountant’s reports, such reports and any cease to hold report required, to be delivered within two months of the end of the period to which they relate; and

2. she attends courses accredited by the SRAuthority on the Solicitors’ Accounts Rules 1998 and the Solicitors’ Code of Conduct 2007(June 2009) by 8 January 2011and provides confirmation of her attendance (in the form of a certificate or letter of attendance from the course provider) on such courses by 8 March 2011.

Reasons/basis

Having regard to Regulation 6 of the SRA Practising Regulations 2009 and the purposes for which conditions may be imposed on a practising certificate the Adjudicator considered that the above conditions are necessary in the public interest and are reasonable and proprotionate.

 This notification relates to a Decision to prosecute before the Solicitors Disciplinary Tribunal. This is an independent Tribunal which will reach its own decision after considering all the evidence, including any evidence put forward by the Solicitor. The Tribunal has certified that there is a case to answer in respect of allegations which are or include that she :-

Acted in breach of the Solicitors Code of Conduct 2007 in that she :

1. Created or permitted to be created Conditional Fee Agreements which were false;

2. Falsely represented and/or permitted to be represented that she had signed documents when a third party had signed them in her name;

3. Held out and/or permitted a third party to hold himself out as a solicitor or an employee of her firm when that third party was neither of those things;

4. Made statements on her application for Professional Indemnity Insurance which were inaccurate.

The allegations are subject to a Hearing before the Solicitors Disciplinary Tribunal and are as yet unproven.
