The Authorised Officer DECIDES to grant Rehana Kausar Saeed a practising certificate for the practice year 2010/2011 subject to the following conditions that:
- 1.1 she is not a sole practitioner or the sole director of a recognised body;
- 1.2 she is not a manager or owner of a recognised body where all other managers or owners
- 1.2.1 have less than 3 years experience practising as a lawyer in a firm regulated by the Solicitors Regulation Authority unless the arrangements have first been approved by the Solicitors Regulation Authority.
- 1.2.2 are recognised bodies of which she is a sole director.
- 1.2.3 Mrs Saeed shall immediately inform any actual or prospective co- manager, or co-owner of these conditions and the reason for their imposition.
Reasons/basis
The Authorised Officer notes that since 2009, Mrs Saeed has been working as a solicitor in approved employment with Nationwide Solicitors. Approval of Mrs Saeed’s employment approval by Nationwide was initially granted by the SRA on 23 September 2009. Further approval to her employment by Nationwide Solicitors was granted when Mrs Saeed’s application for a practising certificate for the practising year 2009/2010 was considered.
The Authorised Officer notes that Mrs Saeed was adjudged bankrupt on 28 October 2009. The Authorised Officer is satisfied that Mrs Saeed’s bankruptcy was automatically discharged on 28 October 2010 and accordingly Mrs Saeed is now subject to Regulation 3.1(k)(i) of the SRA Practising Regulations 2009, rather than Regulation 3.1(j).
The Authorised Officer is of the view that because Mrs Saeed’s bankruptcy came about as a result of monies owed by her former sole practice to the Legal Services Commission, and because a relatively short amount of time has elapsed since the discharge of her bankruptcy, it is appropriate, proportionate and necessary in the public interest that Mrs Saeed should remain subject to regulatory controls and monitoring by the Solicitors Regulatory Authority. However, the Authorised Officer is also of the view that now Mrs Saeed’s bankruptcy has been discharged, it is appropriate to relax the existing approved employment conditions so that Mrs Saeed may not act as a sole principal.
In making the above decision the Authorised Officer has had regard to Regulation 6.1(c) & (e) of the SRA Practising Regulations 2009.

Without prejudice to any outstanding matters or issues, the Authorised Officer DECIDED to grant Mrs Rehana Kausar Saeed a practising certificate for the practice year 2011/2012 free from conditions.
Reasons/basis
The Authorised Officer acknowledged that nearly a year and a half had now passed since Mrs Saeed’s bankruptcy was automatically discharged on 28 October 2010.
The Authorised Officer was satisfied that it would not be necessary, reasonable or proportionate in the interests of protection of the public to impose any practising certificate conditions at this time.
The Authorised Officer was also satisfied that none of the purposes specified in Regulation 7 of the SRA Practising Regulations 2011 make it necessary in the interests of the public to impose any practising certificate condition. Accordingly, the Authorised Officer authorised the issue of an unconditional practising certificate.
