Decision details

To grant Mr Rupert James Humphrey Jackson a practising certificate for the practice year 2011/2012 subject to the following condition:-

1. He is not to be the sole signatory to any office or client account.  

Reasons/basis

Mr Rupert James Humphrey Jackson is subject to Regulation 3.1 of the SRA Practising Regulations 2011, as detailed above, as a consequence of entering into an Individual Voluntary Arrangement in relation to personal debts.

Accordingly, the Authorised Officer was required to consider whether to impose any practising certificate condition in accordance with Regulation 7 of the SRA Practising Regulations 2011 which sets out the purposes for which conditions may, in the public interest, be imposed on a solicitor's practising certificate.

Although Mr Humphrey's IVA has no relation to his work as a solicitor, the Authorised Officer considered that imposing a condition on Mr Jackson's practising certificate would be in the public interest.

In making this decision, the Authorised Officer had consideration to the regulatory objectives set out in Section 1 and 28 of the Legal Services Act 2007 along with the tests set out in the matters of A Odunlami [2008] EWCA Civ 1598 and F Razeen [2008] EWCA Civ 1220. The Authorised Officer was satisfied that, in the light of Mr Jackson's IVA, the above practising certificate conditions are necessary, reasonable and proportionate in the interests of protection of the public.

However, the Authorised Officer emphasised that the condition on Mr Jackson's practising certificate in no way calls into question Mr Jackson's honesty or integrity. Nor is it in any way a reflection of Mr Jackson's regulatory history which to date is unblemished.
