Reasons/basis
This notification relates to a Decision to prosecute before the Solicitors Disciplinary Tribunal. This is an independent Tribunal which will reach its own decision after considering all the evidence, including any evidence put forward by the Solicitor. The Tribunal has certified that there is a case to answer in respect of allegations which are or include that, whilst a partner at Gartsides Solicitors :-
- 1) He failed to rectify breaches to the Solicitors Accounts Rules and failed to ensure compliance with those Rules.
- 2) He utilised clients funds for the payment of office expenses (administration and referral fees).
- 3) He failed to provide clients with adequate costs information.
- 4) He failed to act in the best interests of his clients.
- 5) He made representations to third parties which were misleading, inaccurate and untrue.
- 6) He failed to maintain a record of arrangements for the introduction of work and failed to obtain undertakings from introducers.
- 7) He failed to provide all relevant information to clients upon receipt of referrals.
- 8) He failed to satisfy himself that the introducers had provided clients with relevant information before the referral took place.
The allegations are subject to a Hearing before the Solicitors Disciplinary Tribunal and are as yet unproven.

1. he may act only as a solicitor in employment.
2. he is not a sole practitioner or a manager or owner of a recognised body.
3. Mr Brickley shall immediately inform any actual or prospective employer of these conditions and the reasons for their imposition.
4. In this condition "manager" is as defined in section 207 of the Legal Services Act 2007 and "owner" is defined in rule 24 of the Solicitors Code of Conduct.
Reasons/basis
The Solicitors Regulation Authority considered the conditions imposed pursuant to Regulation 6.1(a) of the SRA Practising Regulations 2009, namely, that imposing the condition will, in the public interest, limit, restrict, halt or prevent the involvement of Mr Brickley in those activities.

Reasons/basis

The SRA has had regard to Regulation 7.1(a) of the SRA Practising Regulations 2011 and considers the above conditions are necessary and appropriate in the interests of the public having regard to his regulatory history.
