The Authorised Officer decided to grant Ms P M Chipatiso a practising certificate for the practice year 2010/2011 subject to the conditions that she may act as a solicitor only in employment which has first been approved by the Solicitors Regulation Authority; she is not a sole practitioner or a manager or owner of a recognised body; Miss Chipatiso shall immediately inform any actual or prospective employer of these conditions and the reasons for their imposition. In this condition “manager” is defined in section 207 of the Legal Services Act 2007 and “owner” is as defined in rule 24 of the Solicitors’ Code of Conduct 2007.
Reasons/basis
The purposes for which conditions may be imposed on a practising certificate in the public interest are set out in Regulation 6 of the SRA Practising Regulations 2009. The Authorised Officer is satisfied that the above conditions which restrict Miss Chipatiso’s practising arrangements and which require the SRA to give its prior written consent to any such arrangements are necessary in order to protect the interests of the public. The conditions are not intended to cast doubt over Miss Chipatiso’s integrity but are imposed as a regulatory measure in the public interest.

The Committee was satisfied that grounds for intervention existed under Paragraph 1(1)(m) of Part I of Schedule 1 to the Solicitors Act 1974 (as amended), namely that the Committee was satisfied that it was necessary to exercise the powers conferred by Part II of this Schedule (or any of them) in relation to Abiloye & Co Solicitors to protect the interests of clients (or former or potential clients) of Mr Alexander Oladapo Olumuyiwa Abiloye and Miss Pamela Mazvita Chipatiso or their firm or the interests of the beneficiaries of any trust which the solicitors are/were trustees.
