To impose the follwing conditions on Mr Brand's current (2010/2011) practising certificate that
- (a) he may act as a solicitor only in employment which has first been approved by the Solicitors Regulation Authority
- (b) he is not a sole practitioner or manager or owner of a recognised body
- (c) he shall immediately inform any actual or prospective employer of these conditions and the reasons for their imposition, and
- (d) In this condition "manager" is as defined in section 207 of the Legal Services Act 2007 and "owner" is as defined in rule 24 of the Solicitors' Code of Conduct.
Reasons/basis
In reaching this decision, the Adjudicator had regard to Regulation 6.1(a) of the SRA Practising Regulations 2009 and was satisfied that Mr Brand was unsuitable to undertake activities in legal practice as a principal or without supervision from an approved employer. The Adjudicator was further satisfied that imposing the conditions will in the public interest limit, restrict halt or prevent his involvement in those activities.

Without prejudice to any outstanding matters and/or issues:
1.The Authorised Officer has DECIDED to grant Mr Robert Simon Brand a practising certificate for the practice year 2011/2012 subject to the conditions that:
- (a) He may act as a solicitor only in employment which has first been approved by the Solicitors Regulation Authority.
- (b) He is not a sole practitioner or manager or owner of a recognised or licensable body
- (c)He shall immediately inform any actual or prospective employer of these conditions and the reasons for their imposition.
- (d) In this condition "manager" is as defined in section 207 of the Legal Services Act 2007 and "owner" is as defined in Chapter 14 of the SRA Code of Conduct 2011.
Reasons/basis
Mr Brand is subject to Regulation 3.1 (g) and (j) of the SRA Practising Regulations 2011 due to the fact that he was made the subject of a Bankruptcy Order on 3 May 2011.
In reaching this decision, the Authorised Officer has given regard to Regulation 7.1 (c) of the SRA Practising Regulations 2011, and is satisfied that Mr Brand is unsuitable to engage in certain business agreements, business associations or practising arrangements and is further satisfied that imposing the conditions will in the public interest limit, halt or prevent a risk to clients, third parties or the public.
