The Adjudicator DECIDED to grant Mr Timothy James Platel a practising certificate for the practice year 2010/2011 subject to the condition that he is not a sole practitioner or sole director of a recognised body.
Reasons/basis
Mr Platel has not held a practising certificate since 2002/2003. When he was in practice he experienced serious financial difficulties that resulted in bankruptcy in 2004 from which he was discharged the following year. Since then, Mr Platel has been working as a freelance legal CPD seminar leader training solicitors and support staff on a range of subjects including the Solicitors’ Code of Conduct 2007.
The purposes for which conditions may be imposed on a practising certificate are set out in Regulation 6 of the SRA Practising Regulations 2009.
Whereas Mr Platel has kept up to date with changes to the rules and regulations of conduct, in light of his absence from private practice the Adjudicator considered he is not suitable to act as sole practitioner where he alone would be responsible for running and managing a business providing legal services (Regulation 6.1 (a)) and that it is in the public interest for the above condition to be imposed.
The Adjudicator is satisfied, in line with paragraph 4A of the SRA’s publication policy, that it is in the public interest to publish this decision.
