The Adjudicator DECIDED to grant Mr Geoffrey Lucas a practising certificate for the practice year 2009/2010 subject to the condition that he undertakes a course accredited by the Solicitors Regulation Authority on the Solicitors’ Code of Conduct 2007 within 6 months of the date of notification of this decision and provides confirmation of the completion of the course (in the form of a certificate or letter of attendance from the course provider) at such course within 8 months of notification of the decision.
Reasons/basis
The Adjudicator considered the Forensic Investigation Report dated 15 December 2008.
In light of the fact that Mr Lucas was found to be in breach of the rules of the Solicitors’ Code of Conduct with regard to agreements with introducers, the Adjudicator was of the opinion that it would be beneficial for Mr Lucas to attend a course on the Solicitors’ Code of Conduct to prevent similar breaches occurring in the future.
Since Mr Lucas applied for a practising certificate for the practice year 2009/2010 the Adjudicator considered that it was necessary and proportionate, in the public interest, to require Mr Lucas to comply with this condition for the purpose set out in Regulation 6.1 (d) SRA Practising regulations 2009
