To grant Mr Chadwick a practising certificate for the practice year 2009/2010 subject to the following conditions that:
1. He is not a sole practitioner or sole director of a recognised body
2. He is not a manager or owner of a recognised body where all the other managers or owners
2.1. have less than 3 years experience practising as a lawyer in a firm regulated by the Solicitors Regulation Authority unless the arrangements have first been approved by the Solicitors Regulation Authority
Reasons/basis
The Authorised Officer acknowledges that Mr Chadwick was discharged from bankruptcy over a year ago. However, in light of Mr Chadwick’s lengthy regulatory and disciplinary history coupled with the fact that his periods of employment in recent years have been of short duration, the Authorised Officer is of the opinion that he should not be solely responsible for complying with the rules and regulations of conduct and that he should not be practising with inexperienced co - principals unless the SRA has, with regard to the latter situation, first satisfied itself as to the proposed arrangements.
The Authorised Officer considers it to be appropriate in the interests of the public and the profession that Mr Chadwick be subject to closer monitoring. The current conditions enable Mr Chadwick to work as a locum solicitor without needing to obtain advance SRA approval. Therefore, the Authorised Officer is of the opinion that the conditions which were imposed on Mr Chadwick's practising certificate for the 2008/2009 practice year, should remain in place for the 2009/2010 practice year.

The Authorised Officer DECIDED to grant Mr Richard Anthony Chadwick a practising certificate for the practice year 2010/2011 free from conditions.
Reasons/basis
In considering Mr Chadwick’s practising certificate application for 2010/2011, the Authorised Officer noted that there have been no issues of regulatory or disciplinary concern to the SRA regarding Mr Chadwick, since the imposition of conditions on his 2009/2010 practising certificate.
Accordingly, the Authorised Officer was satisfied that it is neither proportionate, reasonable nor necessary in the public interest to impose conditions on Mr Chadwick’s practising certificate for the practice year 2010/2011 for any of the purposes set out in Regulation 6.1 of the SRA Practising Regulations 2009.
The Authorised Officer was satisfied, in line with the SRA's publication policy, that it is in the public interest to publish this decision.
