To grant Mr Patrick McLoughney a practising certificate for the practice year 2009/2010 subject to the conditions that from 3 months from the date of the letter notifying Mr McLoughney of this decision (1) he may act as a solicitor only in employment or partnership, or as a manager or owner of a recognised body, the arrangements for which have first been approved by the Solicitors Regulation Authority and (2) Mr McLoughney shall immediately inform any actual or prospective employer, partner, co-manager or co-owner of these conditions and the reasons for their imposition.
Reasons/basis
As a result of Mr McLoughney being subject to an Individual Voluntary Arrangement on 8 July 2008, the SRA is satisfied that the conditions imposed on his practising certificate are appropriate in the interests of the public, namely, to prevent the risk to clients presented by him practising other than in an approved arrangement, so that his professional conduct can be kept under close supervision and any responsibility that he has for ensuring that the firm is compliant with regulatory requirements is shared with other competent owners and managers.
