The Adjudicator DECIDED to give Mr Bailey a written rebuke.
Reasons/basis
Mr Bailey acted in breach of Principle 15.03 of the Guide to the Professional Conduct of Solicitors 1999 (eighth edition) and Rule 3.01 of the Solicitors' Code of Conduct 2007 because he continued to act in a situation where his obligations as a solicitor and executor conflicted with the instructions given by his other executor client. He also acted in breach of Rule 1(c) and (d) of the Solicitors' Practice Rules 1990 and Rules 1.04 and 1.06 of the Solicitors' Code of Conduct 2007 because he deliberately delayed taking action for a period of approximately eight years.
