Reasons/basis

 This notification relates to a decision to prosecute before The Solicitors Disciplinary Tribunal. This is an independent Tribunal which reaches its own decision after considering all the evidence, including any evidence put forward by the solicitor. On 27 October 2009 the Tribunal dealt with the following allegations:-

1. That Mr Douglass participated in a number of transactions on behalf of clients that bore the hallmarks of mortgage fraud contrary to Practice Rule I

2. That Mr Douglass acted in a number of conveyancing transactions for both lender and borrower where a conflict of interest existed or arose contrary to Practice Rule 6(3)(a)

3. That Mr Douglass acted for both buyer and seller without the written consent of both parties contrary to Practice Rule (6)(i)(ii)

4. That Mr Douglass acted in one or more conveyancing transactions for both lender and borrower on the granting of an institutional mortgage of land without informing the lender in writing that he proposed to act for seller, buyer and lender in the same transaction in breach of Practice Rule 6(3)(b)


The above allegations were found to be proven by the Solicitors Disciplinary Tribunal at the hearing on 27 October 2009.
