Decision details
The Authorised Officer DECIDED to grant Mrs Mason a practising certificate for the practice year 2009/2010 subject to the condition that she undertakes a course accredited by the Solicitors Regulation Authority on the Solicitors' Code of Conduct 2007 within 3 months of the date of notification of the decision and provide confirmation of the completion of the course (in the form of a certificate or letter of attendance from the course provider) at such course within 4 months of notification of the decision.
Reasons/basis
The Authorised Officer considered the issues arising from the Practice Standards Unit report of 20 and 21 June 2006 and the Findings of the Solicitors Disciplinary Tribunal of 7 July 2009.
It is noted that the Tribunal did regard the subject matter of the allegation against the Respondents to be serious. It is also noted that Mrs Mason was seen to play "a full part in the scheme which led to the breaches".
In the circumstances, the Authorised Officer was of the opinion that it would be both reasonable and appropriate to impose a condition on Mrs Mason's practising certificate that she undertakes a course on the Code of Conduct to update her knowledge and prevent such a breach from occurring again in the future.
