Decision details

I DECIDE to grant Christopher Adriaan Robin Dickins a practising certificate for the practice year 2010/2011 subject to the following conditions:

1.1 he may act as a solicitor in employment, as an assistant solicitor or consultant (but not as a salaried partner), without the prior approval of the SRA PROVIDED he has no responsibility for, or any involvement in, the accounting functions of the employer;

1.2 while acting as a solicitor, he may only do Criminal Law work and act as a criminal practitioner with Mr Pressler, at Parcton Law Chambers in accordance with the contract held with the Legal Services Commission and any related pro bono work, under the present arrangement, provided he does not hold or have responsibility for client money. Any proposed changes to the current arrangements must be notified in advance and approved by the SRA;

1.3 he may not act, save as permitted in paragraph 1.3 above, as a sole principal or sole director of a recognised body;

1.4 he may act as a partner or manager or owner of a recognised body only where the arrangements have first been approved by the SRA. In this condition “manager” is as defined in Section 207 of the Legal Services Act and “owner” is as defined in rule 24 of the Solicitors Code of Conduct.

1.5. Mr Dickins shall immediately inform any actual or prospective employer, partner, co-member/office holder/shareowner of these conditions and the reasons for their imposition.

Reasons/basis

Mr Dickins is subject to Regulation 3.1(a(i)), (b), (c), (g) and (n) of the SRA Practising Regulations 2009.

The above conditions are imposed pursuant to Regulation 6.1(a) and (c) of the SRA Practising Regulations 2009 as the Solicitors Regulation Authority considers that it is in the public interest that Mr Dickins should only work as a solicitor in respect of publicly funded criminal law work, should not handle client monies, and should not be a manager of a firm (other than as specified in condition 1.2) without the approval of the Solicitors Regulation Authority.

The Authorised Officer DECIDED to grant Mr Christopher Adriaan Robin Dickins a practising certificate for the practice year 2011/2012 subject to the following conditions:-

1. He may act as a solicitor in Criminal Law only, funded by the Legal Services Commission

2. He must not hold, receive or have access to client money

Reasons/basis

Mr Dickins is subject to regulation 3.1 (a)(i), (b), (c), (g) & (n) of the SRA Practising Regulations 2011.

The Authorised Officer notes that Mr Dickins appeared before the Solicitors Disciplinary Tribunal (SDT) on 1 June 2010 facing several serious breaches of the Solicitors Accounts Rules 1998. No dishonesty was alleged, however this was his second appearance before the Tribunal for breaches of the Solicitors Accounts Rules 1998, his first appearance being 6 July 2006.

The Authorised Officer was of the opinion that, given the seriousness of the matters before the Tribunal and their subsequent decision, a conditional practising certificate remains necessary.

Consideration has been given to regulation 7.1(a) & (b) of the SRA Practising Regulations 2011. The Authorised Officer was satisfied that Mr Dickins remains unsuitable to undertake certain activities in relation to a legal practice, and that allowing Mr Dickins to act as a solicitor in criminal law only, funded by the Legal Services Commission, and prohibiting him from holding, receiving or having access to client money will, in the public interest prevent the involvement of Mr Dickins in any other activities.

The Authorised Officer was satisfied that, in the light of Mr Dickins’ recent regulatory history, the above practising certificate conditions are necessary, reasonable and proportionate in the interests of protection of the public.
