To grant Mr Nigel Spencer Jackson a practising certificate for the practice year 2010/2011 subject to the following conditions:
- 1.1 he shall lodge half yearly accountant’s reports, such reports to be delivered within 2 months of the end of the period to which they relate; and
- 1.2 any cease to hold accountant’s report required under the Solicitors’ Accounts Rules is to be delivered within 2 months of the end of the period to which it relates.
Reasons/basis
Mr Jackson is subject, inter alia, to Regulation 3.1(a)(i) of the SRA Practising Regulations 2009, in light of his appearance before the Solicitors Disciplinary Tribunal on 24 January 2008, where he was reprimanded and ordered to pay costs.
The SRA therefore has to consider whether it is proportionate, reasonable and necessary in the public interest to impose any conditions on Mr Jackson’s practising certificate for the practice year 2010/2011, for any of the purposes set out in Regulation 6.1 of the SRA Practising Regulations 2009.
The above condition was imposed on Mr Jackson’s current (2008/2009) practising certificate and again on his 2009/2010 practising certificate (which was not issued).
In considering Mr Jackson’s practising certificate application for the practice year 2010/2011, the Authorised Officer was satisfied that it continues to be proportionate, reasonable and necessary in the public interest to impose the above condition on Mr Jackson’s practising certificate for the practice year 2010/2011, for the purposes of Regulation 6.1(e) of the SRA Practising Regulations 2009.
The Authorised Officer noted that Mr Jackson, in his Reg 3 practising certificate application for the practice year 2010/2011, has indicated that he is content for the condition attached to his current (2008/2009) practising certificate, to continue for the practice year 2010/2011.
The Authorised Officer was satisfied, in line with the SRA's publication policy, that it is in the public interest to publish this decision.

Decision details
To grant Mr Nigel Spencer Jackson a practising certificate for 2011/2012 free from conditions.
Reasons/basis
Mr Jackson is subject to Regulation 3.1 of the SRA Practising Regulations 2011.
Accordingly, the SRA are required to consider whether to impose any practising certificate condition in accordance with Regulation 7 of the SRA Practising Regulations 2011 which sets out the purposed for which conditions may, in the public interest, be imposed on a solicitor’s practising certificate.
The SRA have had consideration to the regulatory objectives set out in Section 1 and Section 28 of the Legal Services Act 2007 along with the tests set out in the matters of A Odunlami [2008] EWCA Civ 1598 and F Razeen [2008] EWCA Civ 1220. However, the SRA are satisfied that none of the purposes specified in Regulation 7 of the SRA Practising Regulations 2011 make it necessary in the interests of the public to impose any practising certificate condition.
