I have DECIDED to grant Mr Simon Arthur Samuel McKay a practising certificate for the practice year 2008/2009 subject to the conditions that:
1. He delivers half yearly accountant's reports, such reports and any Cease to Hold report required to be delivered within 2 months of the end of the period to which they relate.2.He undertakes a course accredited by the Solicitors Regulation Authority on the Solicitors Accounts Rules 1998, within 6 months of the date of notification of this decision and provides confirmation of his attendance (in the form of a certificate or letter of attendance from the course provider) within 2 months of notification of this decision.
Reasons/basis
I am therefore satisfied that these conditions are appropriate and proportionate in the interests of the public and the public confidence in the SRA's effective regulation of the profession and that the training identified will allow Mr McKay to refresh and update his knowledge and skills in this area of practise.

Decision details
To grant Mr Arnsby a practising certificate for the practice year 2009/2010 subject to conditions that:
- 1. If he takes up any position whereby he becomes responsible for, or holds, client money, he is required to deliver half yearly accountant’s reports, such reports and any cease to hold report required, to be delivered within 2 months of the end of the period to which they relate.
- 2. If he takes up any position whereby he becomes responsible for the management of a practice, whether this be on his own account or in partnership, he shall undertake a course accredited by the Solicitors Regulation Authority on Legal Practice Management within six months of taking up such position and provide confirmation of the completion of the course (in the form of a certificate or letter of attendance from the course provider) when he next applies for a practising certificate.
Reasons/basis
In light of Mr Arnsby having established four years of satisfactory conduct, it is therefore appropriate for the conditions on his previous practising certificate to be relaxed so that he may now be permitted to practice either on his own account or as a principal in partnership should he wish to do so.
Notwithstanding this, in light of Mr Arnsby’s regulatory history arising from when he previously practised as a sole practitioner, it is appropriate and proportionate that his compliance with the Solicitors’ Accounts Rules should be subject to a higher degree of monitoring at the current time. Further, in the event that Mr Arnsby takes up any position whereby he has responsibility for the management and running of a practice, whether this be as a sole principal or in partnership, it is appropriate that he should undertake a practice management course so that his knowledge in this area will be refreshed and updated.
