To grant Mr S Browner a practising certificate for the practice year 2010/2011 subjetc to the conditions that
1) he may act as a solicitor in partnership; or as a manager or owner of a recognised body; the arrnagments for which have first been approved by the Solicitors regulation Authority;
2) he is not a manager or owner of a recognised body where all the other managers or owners; have less than 3 years experience practising as a lawyer in a firm regulated by the Solicitors Regulation Authority unless the arrangements have first been approved by the Solicitors Regulation Authority; are recognised bodies of which he is a sole director; Mr Browner shall immediately inform any actual or prospective employer, co-manager, or co-owner of these conditions and the reason for their imposition;
3) In these conditions "manager" is as defined in section 207 of the Legal Services Act 2007 and "owner" is as defined in rule 24 of the Solicitors' code of Conduct; 4
) he is not a sole practitioner or sole director of a recognised body;
5) Mr Browner shall immediately inform actual or prospective partner, co-manager or co-owner of these conditions and the reasons for their imposition.
Reasons/basis
Taking into consideration Mr Browner's appearance before the Solicitors Disciplinary Tribunal, the Authorised Officer considers that it is appropriate in accordance with Regulation 6.1(e) SRA Practising Regulations 2009 that practising conditions remian upon the practising certificate for the practising certificate for 2010/2011.

An Authorised Officer DECIDED to grant Mr Simon James Browner a practising certificate for the practice year 2011/2012 free from conditions.
Reasons/basis
Mr Browner is subject to Regulation 3.1(a)(i), (b), (g) and (n) of the SRA Practising Regulations 2011.
The Authorised Officer had consideration Mr Browner's recent regulatory history along with the regulatory objectives set out in Section 1 and Section 28 of the Legal Services Act 2007 along with the tests set out in the matters of A Odunlami [2008] EWCA Civ 1598 and F Razeen [2008] EWCA Civ 1220.
The Authorised Officer was satisfied that it was not necessary, reasonable or proportionate in the interests of protection of the public to continue to impose the condition imposed on Mr Browner's practising certificate for the practice year 2010/2011. The Authorised Officer was also satisfied that none of the purposes specified in Regulation 7 of the SRA Practising Regulations 2011 make it necessary in the interests of the public to impose any practising certificate condition.
Accordingly, the Authorised Officer authorised the issue of an unconditional practising certificate.
