I have DECIDED to grant Nicholas Robert David Powe a practising certificate for the practice year 2010/2011 subject to the condition that should Mr Powe hold client money he shall deliver half yearly accountant's reports, such reports and any cease to hold report required, to be delivered within 2 months of the end of the period to which they relate.

Reasons/basis

I have noted the details provided in relation to Mr Powe's regulatory history and the circumstances in which he has become subject to Regulation 3.1 of the SRA Practising Regulations 2009. As a result of those matters I have decided that it is necessary, in the public interest, that conditions are imposed on Mr Powe's practising certificate for the purpose set out in Regulation 6.1 (e) of the SRA Practising Regulations 2009.

I have taken into account the comments made by Mr Powe in his letter to the SRA dated 14 March 2011. I consider that the condition set out above is appropriate and proportionate in the circumstances and will, in the event that Mr Powe is in a position of holding client money, facilitate closer monitoring by the SRA of his compliance with the Solicitors Accounts Rules 1998.
