Decision details
An Adjudicator terminated the suspension of Mr Groark's 2009/2010 practising certificate subject to the following conditions:
- (a) He may act as a solicitor only in employment;
- (b) He is not a sole practitioner, manager or owner of a recognised body;
- (c) he shall immediatley inform any actual or prospective employer of these conditions and the reasons for their imposition;
- (d) In this condition "manager" is as defined in section 207 of the Legal Services Act 2007 and "owner" is as defined in Rule 24 of the Solicitors' Code of Conduct 2007.
Reasons/basis
Mr Groark was adjudged bankrupt on 26 April 2010 as a result of his involvement as a partner of Willmett Solicitors. In view of his present financial situation the Adjudicator was satisfied that the above conditions were reasonable, necessary and appropriate in the interests of the public, but that no further restrictions on his practise as a solicitor are required.
