Decision details

To grant Miss M Kofteros a practising certificate for the practice year 2009/2010 subject to the conditions that

she may act as a solicitor only in employment which is first been approved by the Solicitors Regulation Authority;

she is not a sole practitioner or a manager or owner of a recognised body;

Miss Kofteros shall immediately inform any actual or prospective employer of these conditions and the reasons for their imposition.In this condition the manager is as defined in Section 207 of the Legal Services Act 2007 and owner is as defined in Rule 24 of the Solicitors Code of Conduct 2007.

Miss Kofteros undertakes courses accredited by the Solicitors Regulation Authority on the topics of the Solicitors Code of Conduct 2007 and Solicitors Accounts Rules 1998 within six months of the date of notification of this decision and provides confirmation of the completion of the course (in the form of a Certificate or letter of attendance from the course provider) at such course within four months of notification of this decision.

Reasons/basis

In light of the fact that Miss Kofteros has not practised as a solicitor since 1998, her previous regulatory history with the Law Society/SRA and her previous financial history, the Adjudicator was satisfied that the above conditions were necessary in the interests of the public to ensure that when Miss Kofteros returns to practise, she does so in an environment that can offer her an increased level of support and supervision. These conditions are imposed in accordance with Regulation 6.1(c) and (f) of the SRA Practising Regulations 2009.
