The Authorised Officer decides to grant Mr Stephen Round a practising certificate for the practice year 2010/2011 subject to the condition that he shall not be sole signatory to any client or office account cheque or alone authorise electronic transfers from such accounts.
Reasons/basis
The Authorised Officer notes that Mr Round's former firm, of which he was a partner, entered into a PVA to manage the debts of the practice. As a result of this, conditions were placed on his 2009/2010 practising certificate on 6 December 2010 to the effect that he shall not be sole signatory to any client or office account cheque or alone authorise electronic transfers from such accounts.
The Authorised Officer therefore considers that it is necessary appropriate and proportionate to continue the same condition on to his 2010/2011certificate to facilitate closer monitoring by the SRA of his handling of client monies and compliance with the Solicitors Accounts Rules. Having said this, it is noted that at the present time Mr Round, in his role as an Associates at Talbots Legal Advice Centre, has no access to client or office money and is not a signatory on any of the firm's bank accounts. However should the position change in future, this condition will enable the SRA to monitor his compliance with the Solicitors Accounts Rules.
In making the above recommendation the Authorised Officer has had regard to the Regulation 6.1 (a) and (e) of the SRA Practising Regulations 2009.

The Authorised Officer considered that Mr Round is likely to put at risk the interests of the public by taking certain steps in relation to a legal practice, and that imposing the condition will, in the public interest, limit, restrict, halt or prevent the individual of taking such steps (Regulation 7.1(b)). The Authorised Officer was satisfied, in line with the SRA's publication policy, that it is in the public interest to publish this decision.
