To grant Mr Robert Lyon a practising certificate for the practice year 2011/2012 subject to the conditions that:

  • he may act as a solicitor only in employment which has first been approved by the Solicitors Regulation Authority;
  • he is not a sole practitioner or manager or owner of a recognised body;
  • Mr Lyon shall immediately inform any actual or prospective employer of these conditions and the reasons for their imposition;
  • in this condition "manager" and "owner" are as defined in Chapter 14 of the SRA Code of Conduct 2011;
  • Mr Lyon is not a signatory to any client or office account and,
  • does not have the power to authorise electronic payments or transfers from any client or office account and Mr Lyon attends for the purposes of Continuing Professional Development a course on the Solicitors Handbook and provides confirmation of such attendance before he submits an application for his next practising certificate. 

Reasons/basis

Mr Lyon is currently subject to Regulation 3.1[a][i],[b],[c],[f] & [k][i] of the SRA Practising Regulations 2011.

The conditions are imposed having regard to Regulation 3.1(c) of the SRA Practising Regulations 2011 and consider Mr Lyon to be unsuitable to engage in certain business arrangements, business associations or practising arrangments and that imposing a condition requiring Mr Lyon to obtain written approval before taking certain steps will, in the public interest, limit, halt or prevent a risk to clients, third parties or the public.

1. that Mr Lyon may practise as a solicitor, in employment, only;

2. that he is not a sole practitioner or sole director of a recognised body, licensed body or legal services body;

3. that he is not a manager of a recognised body, licensed body or legal services body,

4. Mr Lyon shall immediately inform any actual or prospective employer of these conditions and the reasons for their imposition;

5. In this condition “manager” and “owner” are as defined in Chapter 14 of the SRA Code of Conduct 2011;

6. he is not a signatory to any client or office account and does not have the power to authorise electronic payments or transfers from any client or office account.

Reasons/basis

The SRA publishes regulatory decisions when it considers it to be in the public interest. The Authorised Officer is satisfied, in accordance with the SRA’s publication policy criteria, in order to maintain confidence in the regulatory system and to demonstrate transparency in the SRA’s decision making process, that this decision should be published. The Authorised Officer is satisfied that none of the factors that would make publication inappropriate apply.

Mr Lyon is subject to Regulation 3.1 and 7.1 of the SRA Practising Regulations 2011.

These conditions are imposed having regard to the purposes set out in Regulation 7 of the SRA Practising Regulations 2011 and to the regulatory objectives contained in the Legal Services Act 2007 and the principles governing regulatory activities in section 28 of that Act.
