An Adjudicator DECIDED to grant Mr Cockburn a practising certificate for the practice year 2009/2010 subject to the condition that:

He is not permitted to give any undertakings in the course of practice without the prior consent, recorded in writing, from another member of Megsons LLP.

Reasons/basis

It is of concern however that Mr Cockburn has given undertakings that he has not complied with. In the circumstances the Adjudicator considered he is unsuitable to give undertakings in the course of practise without restriction and that permitting him to do so only with the knowledge and consent of the other Member(s) will be in the public interest (Regulation 6.1 (a) SRA Practising Regulations 2009)). The Adjudicator considered that in the circumstances the condition the Adjudicator had imposed is necessary, reasonable and proportionate.

Reasons/basis

 This notification relates to a Decision to prosecute before the Solicitors Disciplinary Tribunal. This is an independent Tribunal which will reach its own decision after considering all the evidence, including any evidence put forward by the Solicitor. The Tribunal has certified that there is a case to answer in respect of allegations which are or include that he :-

1. Failed to provide relevant information to lender clients

2. Acted for sellers buyers and lenders in the same conveyancing transactions without first informing the lender clients in writing

 3. Acted in a position of conflict and allowed the interests of his purchaser clients to prevail over his duties to his lender clients.

The allegations are subject to a Hearing before the Solicitors Disciplinary Tribunal and are as yet unproven.
