To exercise the powers conferred by Section 16(4) of the Solicitors Act 1974 (as amended) and Regulations 5 and 6 of the SRA Practising Regulations 2009 to terminate the automatic suspension of Mr Ian Kevin Dudley Brand's practising certificate, subject to the following conditions, that: (a) He may act as a solicitor only in employment, (b) He is not a sole practitioner or manager or owner of a recognised body.(c) He shall immediately inform any actual or prospective employer of these conditions and the reasons for their imposition. (d) In this condition "manager" is as defined in section 207 of the Legal Services Act 2007 and "owner" is as defined in rule 24 of the Solicitors’ Code of Conduct.
Reasons/basis
In reaching this decision, the Adjudicator had regard to Regulation 6.1(a) of the SRA Practising Regulations 2009 and was satisfied that a condition that Mr Brand practises only as an employed solicitor will limit and restrict his involvement in certain activities undertaken in legal practice, as it would not be in the interests of the public if he were to undertake such activities as a principal, whilst he was adjudged bankrupt.
