Decision details
To grant Mr Rhoderick Edward Boyd Khilkoff-Boulding a practising certificate for the practice year 2010/2011 subject to the following conditions:
- 1.1
- he may act as a solicitor only:
- in employment or partnership, or
- as a manager or owner of a recognised body,
the arrangements for which have first been approved by the Solicitors Regulation Authority.
- 1.2. Mr Khilkoff-Boulding shall immediately inform any actual or prospective employer, partner, co-manager or co-owner of these conditions and the reasons for their imposition.
- 1.3. In this condition "manager" is as defined in Section 207 of the Legal Services Act 2007 and “owner” is as defined in Rule 24 of the Solicitors’ Code of Conduct 2007.
- 1.4. Mr Khilkoff-Boulding may act as a locum without the prior approval of the SRA for a period of not more than one month in a 2 month period provided that he is supervised by a principal in the practice.
Reasons/basis
The SRA are satisfied that the conditions imposed on his practising certificate are appropriate in the interests of the public, for the purposes set out in regulation 6.1(c) of the SRA Practising Regulations 2009, namely, to prevent the risk to clients presented by Mr Khilkoff-Boulding practising other than in an approved arrangement, so that his professional conduct and compliance with regulatory requirements can be kept under close supervision.

The Adjudicator decided to impose the following conditions on Mr Khilkoff-Boulding's current practising certificate:
(i) He is not a sole practitioner or sole director of a recognised body.
(ii) He may act as a partner or as a manager or owner of a recognised body only where the arrangements have first been approved by the SRA.
Reasons/basis
The Adjudicator considered that it is necessary in the public interest, reasonable and proportionate, in line with Regulation 7.1(b) and (c) of the SRA Practising Regulations 2011, to impose the above immediate conditions on Mtr Khilkoff-Boulding's current practising certificate in force.
