Decision details

The Adjudicator granted Mr John Leyshon a practising certificate for the practice year 2009/2010 subject to the conditions that:

1. He may act as a solicitor only in employment which has first been approved by the Solicitors Regulation Authority.

2. He is not a member, office holder or shareowner of an incorporated solicitor’s practice.

3. He is not a sole principal, partner or salaried partner of any solicitor’s practice.

4. Mr Leyshon shall immediately inform any actual or prospective employer of these conditions and the reasons for their imposition.

Reasons/basis

The Adjudicator noted that Mr Leyshon had complied with the condition attached to his practising certificate for the practice year 2008/2009 and had requested that he be granted a practising certificate free from conditions for the practice year 2009/2010. The Adjudicator had further noted that Mr Leyshon’s former practice of Simpson & Co closed on 30 September 2009 and that he is not currently practising. The Adjudicator had taken careful note of the comments made in a letter from Mr Leyshon and his former partner Mr Simpson dated 13 January 2010.

The Adjudicator took into consideration Mr Leyshon’s regulatory history and noted the matters which remain outstanding which include alleged breaches of the Solicitors Indemnity Rules 2004, Section 41 of the Solicitors Act 1974, Rules 1 and 5 of the Solicitors Code of Conduct 2007 and the Solicitors Accounts Rules 1998 following a Forensic Investigations Report dated 22 July 2009. In all the circumstances the Adjudicator considers, in accordance with Regulation 6.1 (a) SRA Practising Regulations 2009 that Mr Simpson is not a suitable person to undertake legal practice other than in an environment that can provide him with a sufficient degree of both professional support and supervision. The Adjudicator considers that the conditions set out above are necessary and proportionate and will, in the public interest, limit his involvement in legal practice other than in such an environment.

Reasons/basis

This notification relates to a Decision to prosecute before the Solicitors Disciplinary Tribunal. This is an independent Tribunal which will reach its own decision after considering all the evidence, including any evidence put forward by the Solicitor. The Tribunal has certified that there is a case to answer in respect of allegations which are or include :-

That he employed and/or remunerated in connection with their practice as a Solicitor, a former Solicitor whose name had been struck off the Roll of Solicitors, without the prior written consent of the Law Society, contrary to Section 41 (1) of the Solictors Act 1974 (as amended).

The allegations are subject to a Hearing before the Solicitors Disciplinary Tribunal and are as yet unproven.
