To grant Mr S N Hedley a practising certificate for the practice year 2009/2010 subject to the conditions that; (1) he may act as an assistant solicitor or consultant solicitor in employment without the approval of the Solicitors Regulation Authority; (2) he may not act as a manager or owner of a recognised body nor as a recognised sole practitioner without the prior written approval of the Solicitors Regulation Authority; and (3) Mr Hedley shall immediately inform any actual or prospective manager or owner of these conditions and the reasons for their imposition.

Reasons/basis

In light of Mr Hedley’s adverse regulatory history with the SRA and concerns about his compliance with a number of professional Rules including the Solicitors’ Accounts Rules and also to matters that remain to be considered regarding his alleged misconduct, the SRA was satisfied that the matter of risk to the public interest will be adequately managed by the responsibility for Mr Hedley’s supervision as an assistant or consultant and, for ensuring his compliance with the rules and regulations of practice, would be that of his employers. The SRA considered however that should Mr Hedley wish to practise in any other arrangement where he will have managerial responsibilities, it is necessary in the public interest for the SRA to consider such arrangement and give its prior written approval to it.

Reasons/basis

This notification relates to a Decision to prosecute before the Solicitors Disciplinary Tribunal. This is an independent Tribunal which will reach its own decision after considering all the evidence, including any evidence put forward by the Solicitor. The Tribunal has certified that there is a case to answer in respect of allegations which are or include that Mr Hedley:

  • 1. Has acted for more than one client in relation to certain transactions in circumstances of conflict between the interests of the clients involved and/or where his interests conflicted with those of his clients.
  • 2. Failed to comply with the Solicitors Accounts Rules 1998 in that he failed to deal appropriately with client money in breach of SAR 1.
  • 3. Has paid money other than client money into the client account in breach of Rule 15
  • 4. Has facilitated the withdrawal of money from client account other than in accordance with Rule 22

The allegations are subject to a Hearing before the Solicitors Disciplinary Tribunal and are as yet unproven.

 To grant Mr Simon Nigel Hedley a practising certificate for the practice year 2010/2011 subject to the following conditions :

1 he may act as an assistant solicitor or consultant solicitor in employment without the approval of the Solicitors Regulation Authority.

1.1 he may not act as a manager or owner of a recognised body nor as a recognised sole practitioner without the prior written approval of the Solicitors Regulation Authority.

1.2 Mr Hedley shall immediately inform any actual or prospective manager or owner of these conditions and the reasons for their imposition.

1.3 In this condition “manager” is as defined in Section 207 of the Legal Services Act 2007 and “owner” is as defined in Rule 24 of the Solicitors’ Code of Conduct 2007.

Reasons/basis

 The Authorised Officer is satisfied that should Mr Hedley wish to practise in any other arrangement where he will have managerial responsibilities, it is necessary in the public interest for the SRA to consider such arrangement and give its prior written approval to it under Regulation 6.1(c).
