Reasons/basis
Mr Jefferies is subject to Regulation 3.1(b) of the SRA Practising Regulations 2009.
The condition above is imposed pursuant to Regulation 6.1(d) of the SRA Practising Regulations 2009 as the Adjudicator considers that imposing that condition will, in the public interest, require Mr Jefferies to take the specified step conducive to the carrying on of efficient practice by him.

This notification relates to a Decision to prosecute before the Solicitors Disciplinary Tribunal. This is an independent Tribunal which will reach its own decision after considering all the evidence, including any evidence put forward by the Solicitor. The Tribunal has certified that there is a case to answer in respect of allegations which are or include that he :-
1) Made payments to introducers for the referral of Personal Injury work at a time when payments were prohibited.
2) Made referral payments to separate businesses in which he was a sole Director and share holder and failed to disclose his personal interest to clients and thereby created a conflict or a significant risk of a conflict
3) Acted contrary to Rules 1 & 3 of the Solicitors Practice Rules and/or Rules 9.01, 9.02, 9.03(1) and (2) of the Solicitors Code of Conduct in relation to the referral arrangements with the separate businesses.
4) Failed to notify clients that the separate business "LMAL" was not regulated by the SRA and that the statutory protection attaching to clients of a firm regulated by the SRA were not available to clients of the separate business.
5) Retained commission belonging to clients without having obtained the clients informed consent to do so.
The allegations are subject to a Hearing before the Solicitors Disciplinary Tribunal

Reasons/basis
Mr Jefferies had a condition imposed on his practising certificate for the practice year 2010/2011 that he undertakes a course accredited by the Solicitors Regulation Authority on Rule 2 (client care) of the Solicitors Code of Conduct 2007 (with a minimum of 3 CPD points attached to that course) within 6 months of the date of the issue of her practising certificate.
Mr Jefferies has provided documentary evidence of his attendance on a Code of Conduct 2007 (including Rule 2) training course on 1 March 2011. The SRA are satisfied that Mr Jefferies has now complied with this condition imposed on his previous practising certificate.
The SRA are satisfied it would not be necessary, reasonable or proportionate in the interests of protection of the public to impose any practising certificate condition at this time. The SRA are further satisfied that none of the purposes specified in Regulation 7 of the SRA Practising Regulations 2011 make it necessary in the interests of the public to impose any practising certificate condition.
