This notification relates to a Decision to prosecute before the Solicitors Disciplinary Tribunal. This is an independent Tribunal which will reach its own decision after considering all the evidence, including any evidence put forward by the Solicitor. The Tribunal has certified that there is a case to answer in respect of allegations which are or include that Mr Brown :-
- Acted in a conflict or potential conflict of interest situation.
- Breached Rule 1.03 of the Code and/or Rule 1(a) of the Solicitors Practice Rules 1990
- He compromised or impaired or acted in a way which was likely to compromise or impair his independence or integrity, his good repute or that of the solicitors' profession and his duty to the Court.
- He provided inaccurate and misleading information to a third party.
- He permitted his firm's client account to be used to provide banking facilities to clients.
The allegations are subject to a Hearing before the Solicitors Disciplinary Tribunal and are as yet unproven.

Decision details
Pursuant to the provisions of Regulation 6 of the SRA Practising Regulations 2009, to impose immediate conditions upon the current practising certificate of Mr David Eric Brown that he attend courses approved by the Solicitors Regulation Authority on the Solicitors Accounts Rules 1998 and the Solicitors Code of Conduct 2007 within 6 months of the date of notification of this decision and shall provide confirmation of his attendance (in the form of a certificate or letter of attendance) at such courses (within 7 months of this decision). For the avoidance of doubt, Mr Brown is to attend 2 separate courses.

The conditions are imposed in accordance with Regulation 6.1(d) of the SRA Practising Regulations 2009.
