Reasons/basis
The reason for the intervention was that the Panel of Adjudicators Sub-Committee resolved that Mr Evans had failed to comply with the Solicitors Accounts Rules 1998 and the Solicitors Code of Conduct 2007.
The Committee further resolved that it was necessary to exercise the intervention powers to protect the interests of clients (or former clients) of Mr Evans.
Camden Town has been appointed to act as the Authority’s agent. His first attendance to uplift practice papers was on 10 November 2011.

Reasons/basis
This notification relates to a Decision to prosecute before the Solicitors Disciplinary Tribunal. This is an independent Tribunal which will reach its own decision after considering all the evidence, including any evidence put forward by the Solicitor. The Tribunal has certified that there is a case to answer in respect of allegations which arise out of a Forensic Investigations Report dated 31 August 2011 and relate to breaches of the Solicitors Accounts Rules 1998 (SAR) and include that Mr Evans:
(a) Withdrew money from client account in circumstances other than permitted which he then used for his own benefit.
(b) Failed to reconcile his client account in accordance with the requirements of the SAR
(c) Failed to remedy breaches of the SAR promptly upon discovery
The allegations are subject to a Hearing before the Solicitors Disciplinary Tribunal and are as yet unproven.

An Authorised Officer DECIDED to grant Mr Nicholas Evans a practising certificate for the practice year 2011/2012 subject to the following conditions:
1.1 he may act as a solicitor only in employment which has first been approved by the Solicitors Regulation Authority.
1.2 he is not a sole practitioner or a manager or owner of a recognised body.
1.3 Mr Evans shall immediately inform any actual or prospective employer of these conditions and the reasons for their imposition.
1.4 In this condition "manager" and "owner" are as defined in Chapter 14 of the SRA Code of Conduct 2011.
1.5 he is not a signatory to any client or office account and does not have the power to authorise electronic payments or transfers from any client or office account.
Reasons/basis
Mr Evans is subject to Regulation 3.1(a)(iii) and (d)(iii) of the SRA Practising Regulations 2011.
The Authorised Officer has imposed the conditions at paragraphs 1.1 - 1.4 above after having regard to Regulation 7.1(c) of the SRA Practising Regulations 2011 and considers Mr Evans to be unsuitable to engage in certain business agreements, business associations or practising arrangements and that imposing a condition requiring Mr Evans to obtain written approval before taking certain steps will, in the public interest, limit, halt or prevent a risk to clients, third parties or the public.
The Authorised Officer imposed the condition at paragraph 1.5 above after having regard to Regulation 7.1(a) of the SRA Practising Regulations 2011 and considers Mr Evans to also be unsuitable to undertake certain activities in relation to a legal practice and imposing the condition, in the public interest, will prevent Mr Evans' involvement.
