Mr Hanley acted in breach of Rule 1.02 and Rule 1.06 of the Solicitors' Code of Conduct 2007 because he deliberately misled a prospective defendant's insurers for a period of about three months by claiming to have issued protective court proceedings before the expiry of the limitation period when he had not done so, thereby causing the insurers to act to their detriment.
Mr Hanley was given a written rebuke and directed to pay a financial penalty of £1000.
