To issue Mr Onyearu a practising certificate for the practice year 2010/2011subject to the following conditions:
(1) that he may act as a solicitor only in employment which has first been approved by the SRA
(2) he is not a sole practitioner or a manager or owner of a recognised body
(3) he shall immediately inform any actual or prospective employer of these conditions and the reasons for their imposition and
(4) in this conditon "manager" is as defined in Section 207 Legal Services Act 2007 and "owner" is as defined in Rule 24 Solicitors' Code of Conduct 2007
Reasons/basis
The Authorised Officer is satisfied that in light of Mr Onyearu's current financial position, it is in the interests of the public and the reputation of the profession that Mr Onyearu's practising arrangements be monitored more closely by the SRA: Regulation 6.1(c) SRA Practising Regulations 2009.

This notification relates to a Decision to prosecute before the Solicitors Disciplinary Tribunal. This is an independent Tribunal which will reach its own decision after considering all the evidence, including any evidence put forward by the Solicitor. The Tribunal has certified that there is a case to answer.
The matter was heard on 25 October 2012
Mr Onyearu was fined £7,000
and further:-
i) May not practise as a Sole Practitioner, partner of a recognised Body or member of a Limited Liability Partnership (LLP), Legal Disciplinary Practice (LDP) or Alternative Buisness Structure (ABS).
ii) For the avoidance of doubt may only work as a solicitor in employment approved by the Solicitors Regulation Authority
iii) There be liberty to either party to apply to the Tribunal to vary the conditions set out above.

Reasons/basis
On 5th December 2011, the Committee resolved to intervene into the practices of Charles Obinna Odiachi Spiropoulos (Roll No: 682) and Andrew Obinna Kalu Onyearu (Roll No: 162010) who practised as Andrews Solicitors (264637) at 90-92 Rye Lane, London, SE15 4RZ.
The grounds for intervention were that:
- 1. Mr Onyearu and Mr Spiropoulos were both adjudged bankrupt on 3rd March and 15th April 2011 respectively, and
- 2. It was necessary to exercise the powers of intervention in relation to Mr Onyearu and Mr Spiropoulos to protect the interests of clients (or former or potential clients) of Mr Onyearu and Mr Spiropoulos and/or Andrews Solicitors, or the interests of the beneficiaries of any trust which they are or were trustees.
Mr Onyearu and Mr Spiropoulos do not hold current practising certificates.
