Decision details

The Adjudicator decided to grant Mr Salmon a practising certificate for the practice year 2010/2011 subject to conditions that

  • he may act as solicitors only in employment which has first been approved by the Solicitors Regulation Authority;
  • he is not a sole practitioner or manager or owner of a recognised body; he shall immediately inform any actual or prospective employer of these conditions and the reasons for their imposition;
  • he is not a signatory to any client or office bank account;
  • he does not hold, receive or have responsibility for client monies;
  • Mr Salmon is to be directly supervised by a solicitor who is qualified to supervise a practice in accordance with Rule 5.02 of the Solicitors Code of Conduct 2007 and who holds a practising certificate free from conditions;
  • and in this condition “manager” is as defined in section 207 of the Legal Services Act 2007 and “owner” is as defined in rule 24 of the Solicitors’ Code of Conduct.

Reasons/basis

The Adjudicator considers that requiring Mr Salmon to obtain the approval of the SRA before engaging in certain practising arrangements will in the public interest limit any risk to third parties pursuant to Regulation 6.1 (c) of the SRA Practicing Regulations 2009. The Adjudicator also considers that imposing the above conditions will facilitate closer monitoring by the SRA of compliance with the rules and regulations pursuant to Regulation 6.1 (e) of the SRA Practicing Regulations 2009.

Reasons/basis

The Authorised Officer is satisfied that it is not necessary, reasonable or proportionate in the interests of protection of the public to impose any practising certificate condition at this time. The Authorised Officer is also satisfied that none of the purposes specified in Regulation 7 of the SRA Practising Regulations 2011 make it necessary in the interests of the public to impose any practising certificate condition. Accordingly, the Authorised Officer authorises the issue of an unconditional practising certificate.
