Reasons/basis
This notification relates to a Decision to prosecute before the Solicitors Disciplinary Tribunal. This is an independent Tribunal which will reach its own decision after considering all the evidence, including any evidence put forward by the Solicitor. The Tribunal has certified that there is a case to answer in respect of allegations which are or include that she :-
1) Acted contrary to Rules 1 & 3 of the Solicitors Practice Rules and/or Rules 9.01, 9.02, 9.03(1) and (2) of the Solicitors Code of Conduct in relation to the referral arrangements with the separate businesses.
2) Failed to notify clients that the separate business "LMAL" was not regulated by the SRA and that the statutory protection attaching to clients of a firm regulated by the SRA were not available to clients of the separate business.
3) Retained commission belonging to clients without having obtained the clients informed consent to do so.
The allegations are subject to a Hearing before the Solicitors Disciplinary Tribunal

To grant Monina Maeve Ramsden a practising certificate for the practice year 2010/2011 subject to the condition that she undertakes a course accredited by the Solicitors Regulation Authority on Rule 2 (client care) of the Solicitors Code of Conduct 2007 (with a minimum of 3 CPD points attached to that course) within 6 months of the date of the issue of her practising certificate and provides confirmation of the completion of the course (in the form of a certificate or letter of attendance from the course provider) at such course within 7 months of the date of the issue of her practising certificate.
Reasons/basis
Miss Ramsden is subject to Regulation 3.1(b) of the SRA Practising Regulations 2009.
The condition above is imposed pursuant to Regulation 6.1(d) of the SRA Practising Regulations 2009 as the Adjudicator considers that imposing that condition will, in the public interest, require Miss Ramsden to take the specified step conducive to the carrying on of efficient practice by her.

Reasons/basis
Miss Ramsden had a condition imposed on her practising certificate for the practice year 2010/2011 that she undertakes a course accredited by the Solicitors Regulation Authority on Rule 2 (client care) of the Solicitors Code of Conduct 2007 (with a minimum of 3 CPD points attached to that course) within 6 months of the date of the issue of her practising certificate.
Miss Ramsden has provided documentary evidence of her attendance on a Code of Conduct 2007 (including Rule 2) training course on 1 March 2011. The SRA are satisfied that Miss Ramsden has now complied with this condition imposed on her previous practising certificate.
The SRA are satisfied it would not be necessary, reasonable or proportionate in the interests of protection of the public to impose any practising certificate condition at this time. The SRA are further satisfied that none of the purposes specified in Regulation 7 of the SRA Practising Regulations 2011 make it necessary in the interests of the public to impose any practising certificate condition.
