An Adjudicator DECIDED pursuant to Section 16(4) of the Solicitors Act 1974 (as amended) and Regulation 5 and 6 of the SRA Practising Regulations 2009 to terminate the automatic suspension of Mr Walker's practising certificate for the practice year 2008/2009 subject to the following conditions:

1. he may act as a solicitor only in employment which has first been approved by the Solicitors Regulation Authority;

2. he is not a sole practitioner or a manager or owner of a recognised body;

3. Mr Walker shall immediately inform any actual or prospective employer of these conditions and reasons for their imposition;

4. in this condition 'manager' is as defined in the Legal Services Act 2007 and 'owner' is as defined in rule 24 of the Solicitors' Code of Conduct.

Reasons/basis

Mr Walker was adjudged bankrupt in September 2009 for reasons not relating to his practice. The Adjudicator was satisfied that it is appropriate to terminate the suspension to permit Mr Walker to continue to practice as a solicitor subject to conditions.

Given Mr Walker's serious financial difficulties the Adjudicator considered that he is not suitable to undertake the activities of a sole principal or manager or owner of a recognised body and that requiring him to obtain the SRA's written approval to his practising arrangements will be in the public interest (Regulation 6.1(c)).
