To terminate the automatic suspension of Mr Duncan Mark Emmerson's practising certificate for the practice year 2008/2009 as a result of an order of bankruptcy, pursuant to Regulation 5(a) and 6 of the SRA Practising Regulations 2009 and Section 16(4) of the Solicitors Act 1974 (as amended), subject to the conditions that (1) he may act as a solicitor only in employment which has first been approved by the Solicitors Regulation Authority; (2) he is not a sole practitioner or a manger or owner of a recognised body: and (3) he shall immediately inform any actual or prospective employer of these conditions and the reasons for their imposition.
Reasons/basis
As a result of Mr Emmerson's bankruptcy on 16 November 2009, the SRA was satisfied that it will be in the interests of the public that Mr Emmerson should only continue to practise as a solicitor subject to a degree of supervision and support.
