This notification relates to a Decision to prosecute before the Solicitors Disciplinary Tribunal. This is an independent Tribunal which will reach its own decision after considering all the evidence, including any evidence put forward by the Solicitor. The Tribunal has certified that there is a case to answer in respect of allegations which are or include that Ms Michaelson :-
- 1) Compromised or impaired her independence or integrity, or was likely to do so;
- 2) Compromised or impaired her duty to act in the best interests of the client, or was likely to do so;
- 3) Compromised or impaired her good repute or that of the Solicitors' profession, or was likely to do so;
- 4) Used her position as a Solicitor to take unfair advantage for herself ;
- 5) Withdrew client money from client account in circumstances other than permitted by Rule 22 of the Solicitors Accounts Rules 1998 ;
The allegations are subject to a Hearing before the Solicitors Disciplinary Tribunal and are as yet unproven.
