This notification relates to a decision to prosecute before The Solicitors Disciplinary Tribunal. This is an independent Tribunal which will reach its own decision after considering all the evidence, including any evidence put forward by the solicitor. The Tribunal has certified that there is a case to answer in respect of allegations which are or include:-
1. A failure to disclose information to lender clients and to act
in their best interests.
2. The improper release of funds to borrower clients.
3. The failure and/or delay in complying with undertakings
given to lender clients.
4. Acting in transactions bearing the hallmarks of money
laundering and potential mortgage fraud.
5. The failure to act in the best interests of a client.
6. Acting for two or more clients when a conflict or potential
conflict existed.
7. Failure to deal properly with a client complaint.
The allegations are subject to a hearing before the Solicitors Disciplinary Tribunal and is as yet unproven.
