Decision details

Dr Briggs' practising certificate for the 2010/2011 practice year was granted subject to the conditions that he may act as a solicitor only in employment which has first been approved by the SRA. He is not permitted to be a sole practitioner, manager or owner of a recognised body and he must immediatley inform any actual or prospective employer of these conditions and the reasons for their imposition. In this condition "manager" is as defined in section 207 of the Legal Services Act 2007 and "owner" is as defined in rule 24 of the Solicitors Code of Conduct 2007.

Reasons/basis

Dr Briggs has had two appearances before the Solicitors Disciplinary Tribunal ("the Tribunal") since his admission as a solicitor in 2001. In September 2004, the Tribunal suspended Dr Briggs from practice for a period of 1 year and in July 2008 the Tribunal suspended him for a period of 3 months. The Authorised Officer was satisfied that the above practising certificate conditions are appropriate, proportionate and necessary in the interests of the protection of the public. Such a condition will allow the SRA to monitor Dr Briggs’ practise as a solicitor more closely. In making the above decision the Authorised Officer had regard to Regulation 6.1(c) & (e) of the SRA Practising Regulations 2009.
