Without prejudice to any outstanding matters or issues:

A Committee DECIDED to grant Ms Clift a practising certificate for the practice year 2009/2010 subject to the following conditions:

1. she is not a sole practitioner or sole director of a recognised body

2. she is not a manager or owner of a recognised body where all the other managers or owners

2.1 have less than 3 years experience practising as a lawyer in a firm regulated by the Solicitors Regulation Authority unless the arrangements have first been approved by the Solicitors Regulation Authority.

2.2 are recognised bodies of which she is a sole director

3. Ms Clift shall immediately inform any actual or prospective employer, co-manager, or co-owner of these conditions and the reasons for their imposition.

4. she delivers half yearly accountant’s reports, such reports and any Cease To Hold report required, to be delivered within 2 months of the end of the period to which they relate.

5. undertakes a course accredited by the Solicitors Regulation Authority on Solicitors’ Code of Conduct 2007 referring specifically to supervision within 6 months of the date of notification of this decision and provides confirmation of the completion of the course (in the form of a certificate or letter of attendance from the course provider) at such course within 2 months of the completion of the course.

Reasons/basis

The Committee had regard to Regulation 6.1(a) and (d) of the SRA Practising Regulations 2009. In light of the issues raised in the Forensic Investigations report dated 10 September 2008, the Adjudication Panel’s decision of 22 October 2008 and failure to comply with practising certificate conditions imposed on her practising certificate for the practice year 2008/2009. The Committee was satisfied that the above conditions are reasonable, necessary and proportionate.
