Decision details

Considered an application by Miss Sukhinder Kaur Kooner for a practising certificate for the practice year 2011/2012. Miss Kooner’s application is subject to the provisions of regulation 3.1(a), (k) and 9n) of the SRA Practising Regulations 2011.

Without prejudice to other outstanding matters or issues, the Adjudicator DECIDED:

To grant Miss Sukhinder Kaur Kooner a practising certificate for the practice year 2011/2012 subject to the following conditions:

  • she is not a sole practitioner or sole director of a recognised body;
  • she is not a manager or owner of a recognised body where all the other managers or owners;
  • have less that 3 years experience practising as a lawyer in a firm regulated by the Solicitors Regulation Authority unless the arrangements have first been approved by the Solicitors Regulation Authority;
  • are recognised bodies of which she is a sole director.

Miss Kooner shall immediately inform any actual or prospective employer, co-manager, or co-owner of these conditions and the reasons for their imposition.

The above conditions are to come into effect 2 months from the date of notification of this decision, save for the notification requirements in paragraph 3.6 which shall come into effect immediately.  

Reasons/basis

The Adjudicator has carefully considered the circumstances which led to Ms Kooner appearing before the Solicitors Disciplinary Tribunal in June 2012 and the Tribunal’s decision and recommendations. The Adjudicator is satisfied that there is a risk that Miss Kooner will, if allowed to practice in an unrestricted manner, present a significant risk to clients and the public and cause damage to the reputation of the solicitors profession. Accordingly the Adjudicator considers that it is necessary, in the public interest, to impose the above conditions for the purposes set out in regulation 7.1(a), (c) and (d) of the SRA Practising Regulations 2011. The Adjudicator is further satisfied that the conditions set out above are reasonable and proportionate in achieving those purposes.
