Decision details
Mr Peter John Egan was granted a practising certificate for the practice year 2008/2009 subject to the conditions that (1) he is not a sole practitioner or a manager or owner of a recognised body; (2) he is not a manager or owner of a recognised body where all the other managers or owners (2.1) have less than 3 years experience practising as a lawyer in a firm regulated by the SRA unless the arrangements have first been approved by the SRA (2.2) are recognised bodies of which he is a sole director; and (3) attends courses on the Solicitors Accounts Rules, the Solicitors Code of Conduct 2007 and the Legal Services Act 2007.
Reasons/basis
Mr Egan has not practised as a solicitor for 4 years and as a result of his earlier professional difficulties which had arisen when he practised on his own account, it is in the interests of the public or the reputatiion of the profession that he is not permitted to operate as a sole practitioner. Further, there have been a number of significant changes to the rules and regulations governing solicitors since Mr Egan last held a practising certificate, and as a result, Mr Egabn was therefore required to undertake the training specified in the condition.
