To grant Mr Kola a practising certificate for the practice year 2009/2010 subject to the following conditions that:
1. He delivers half yearly Accountant’s Reports, such Reports and any Cease to Hold Reports to be delivered within 2 months of the end of the period to which they relate
2. He attends a course accredited by the SRA on The Solicitors’ Accounts Rules 1998 within 6 months of the notification of this decision and provides confirmation of attendance (in the form of a certificate or letter of attendance from the course provider) within 8 months of the notification of this decision.
Reasons/basis
It is the duty of the SRA to maintain public confidence in the effective regulation of the profession and accordingly the Authorised Officer is of the opinion that it remains necessary in the interests of the public that Mr Kola continue to be subject to additional monitoring. In addition, the Authorised Officer is of the opinion that Mr Kola should attend a course on the Solicitors’ Accounts Rules 1998 to ensure that his knowledge is refreshed and updated.

The Adjudicator decided to grant Mr Kola a practising certificate for the practice year 2010/2011 subject to the following conditions:
- 1. He may only act as a solicitor:
- 1.1 in employment or partnership, or
- 1.2 as a manager or owner of a recognised body
- the arrangements for which have first been approved by the Solicitors Regulation Authority.
- 2. Mr Kola shall inform any actual or prospective employer, partner, co-manager or co-owner of these conditions and the reasons for their imposition.
- 3. In this condition "manager" is as defined in section 207 of the Legal Services Act 2007 and "owner" is as defined in rule 24 of the Solicitors" Code of Conduct 2007.
- 4. He delivers half yearly accountant's reports, such reports and any cease to hold report to be delivered within 2 months of the end of the period to which they relate.
Reasons/basis
Mr Kola is subject to Regulation 3.1 (a)(i), (b), (g) and (n) of the SRA Practising Regulations 2009.
The Adjudicator had regard to Regulation 6.1(c) of the SRA Practising Regulations 2009. The Adjudicator considered Mr Kola to be unsuitable to engage in certain practising arrangements and that imposing a condition requiring Mr Kola to obtain the SRA's written approval before taking certain steps will, in the public interest, prevent a risk to clients, third parties and the public.
The Adjudicator also had regard to Regulation 6.1(e) of the SRA Practising Regulations 2009 and considered the imposition of the delivery of half-yearly accountant's reports will, in the public interest, facilitate closer monitoring of Mr Kola's compliance with the rules and regulations of the profession.
The Adjudicator was satisfied that the above conditions are both necessary in the public interest and proportionate in the circumstances.
