The Adjudicator decided to grant Mr Kola a practising certificate for the practice year 2010/2011 subject to the following conditions:

  • 1. He may only act as a solicitor:
    • 1.1 in employment or partnership, or
    • 1.2 as a manager or owner of a recognised body
  • the arrangements for which have first been approved by the Solicitors Regulation Authority.
  • 2. Mr Kola shall inform any actual or prospective employer, partner, co-manager or co-owner of these conditions and the reasons for their imposition.
  • 3. In this condition "manager" is as defined in section 207 of the Legal Services Act 2007 and "owner" is as defined in rule 24 of the Solicitors" Code of Conduct 2007.
  • 4. He delivers half yearly accountant's reports, such reports and any cease to hold report to be delivered within 2 months of the end of the period to which they relate.

Reasons/basis

Mr Kola is subject to Regulation 3.1 (a)(i), (b), (g) and (n) of the SRA Practising Regulations 2009.

The Adjudicator had regard to Regulation 6.1(c) of the SRA Practising Regulations 2009. The Adjudicator considered Mr Kola to be unsuitable to engage in certain practising arrangements and that imposing a condition requiring Mr Kola to obtain the SRA's written approval before taking certain steps will, in the public interest, prevent a risk to clients, third parties and the public.

The Adjudicator also had regard to Regulation 6.1(e) of the SRA Practising Regulations 2009 and considered the imposition of the delivery of half-yearly accountant's reports will, in the public interest, facilitate closer monitoring of Mr Kola's compliance with the rules and regulations of the profession.

The Adjudicator was satisfied that the above conditions are both necessary in the public interest and proportionate in the circumstances.
