Decision to intervene into practice.
Reasons/basis
The reasons for the decision were that the Committee resolved that:
1) Mr Bevan and Mr Hollebon and Bevans Bray Walker Ltd had failed to comply with the SRA Accounts Rules 2011 and the SRA Principles 2011.
2) Intervention was neccesary to protect the interests of cleints (or former or potential clients of Mr Bevan and Mr Hollebon or Bevans Bray Walker Limited or the beneficiaries of any trust for which they are or were a trustee.
3) Grounds for intervention existed under Paragraph 32(1)(c) of the Administration of Justice Act 1985 as a relevant insolvency event had occurred by virtue of Bevans Bray walker Limited entering into administration.
Other information
The PC's of Mr Bevan and Mr Holebon were suspended by virtue of the intervention resolution. No resolution was passed in relation to Robert Jones, Hugh Feeny and Stephen Brice. Although they are not currently authorised as a firm of solicitors they continue to hold unconditional practising certificates. Mr Hollebon has indicated that he intends to challenge the intervention into his practice at the High Court.

Decision details
To grant the application of Mr Hollebon to terminate the suspension of his practising certificate for the practice year 2011/201, subject to the following conditions:
- 1) He is not a sole practitioner;
- 2) He may act as a manager or owner of a recognised body (as defined within the Glossary of the SRA Handbook 2011) only where the arrangements have first been approved by the SRA;
- 3) He informs any actual or prospective employer of these conditions and the reason for their imposition.
Reasons/basis
The Adjudicator considers that Mr Hollebon represents a risk to clients and the public which the Adjudicator addressed by imposing a condition that he may not practise as a sole practitioner, and can only act as a manger or owner where the arrangements have first been approved by the SRA. In this role, he will not have the responsibilities of management or supervision that the Solicitors Regulation Authority expects a sole principal, and any manager or owner of a recognised body, to discharge except with the express approval of the SRA.
For the purpose identified in Regulation 7.1 (a) of the SRA Practising Regulations 2011, the Adjudicator is satisfied that the above conditions are reasonable, necessary and appropriate for the purpose of achieving an effective regulatory outcome which will benefit and protect clients and the public.
The Adjudicator was satisfied, in line with the SRA’s publication policy, that it is in the public interest to publish this decision in order to maintain public confidence in the regulatory system and to demonstrate transparency in the SRA’s decision making processes. The Adjudicator was also satisfied that none of the factors that would make publication inappropriate now apply.
