This notification relates to a Decision to prosecute before the Solicitors Disciplinary Tribunal. This is an independent Tribunal which will reach its own decision after considering all the evidence, including any evidence put forward by the Solicitor. The Tribunal has certified that there is a case to answer in respect of allegations which are or include that Mr Adelasoye:-
Acted contrary to the Solicitors Code of Conduct (Rules 1.02, 1.06 and 10.01) in that, on two occasions, he submitted a false mortgage reference form to lenders. The forms were false in that they gave enhanced salary details for himself when in each case his employer had neither completed nor submitted the form.
The allegation is subject to a Hearing before the Solicitors Disciplinary Tribunal and is as yet unproven.

1. Within 3 months from the date of notification of this decision he may act as a solicitor only (a) in employment or partnership, or (b) as a manager or owner of a recognised body, the arrangments for which have first been approved by the SRA. 2. With immediate effect, he shall immediately inform any actual or prospective employer, partner, co-manager or co-owner of these conditions and the reasons for their imposition. 3. In this condition "manager" is as defined in section 207 of the Legal Services Act 2007 and "owner" is as defined in rule 24 of the Solicitors' Code of Conduct.
Reasons/basis
Pursuant to Regulation 6(1)(c) of the SRA Practising Regulations 2009, Mr Adelasoye's current practising arrangement is unsuitable and the above conditions are necessary for the purposes of halting and preventing the risk to clients presented by him continuing to practise without any support, monitoring or supervision. It is in the interests of the public for the above conditions to be imposed on Mr Adelasoye's practising certificate.

Reasons/basis
1. The Committee was satisfied that grounds for intervention exist under Paragraph 1(1)(e) of Part I of Schedule 1 Solicitors Act 1974 (as amended) in light of the fact that on 6 September 2010 Mr Mutalib Kayode Abiodun Michael Adelasoye, sole principal of Ark of Hope Consulting, was sentenced by the Crown Court to a period of imprisonment.
2. The Committee was satisfied that grounds for intervention exist under Paragraph 1(1)(m) of Part I of Schedule 1 Solicitors Act 1974 (as amended) namely that the Committee was satisfied that it is necessary to exercise the powers conferred by Part II of this schedule (or any of them) in relation to Ark of Hope Consulting Solicitors to protect the interests of the clients (or former potential clients) of Mr Mutalib Kayode Abiodun Michael Adelasoye or his firm or the interests of the beneficiaries of any trust which Mr Mutalib Kayode Abiodun Michael Adelasoye was a trustee.
