Decision details
An Adjudicator DECIDED to terminate the suspension of Mr Kwasi Boakye Yiadom’s practising certificate for the practice year 2009/2010, pursuant to Section 16(4) of the Solicitors Act 1974 (as amended) and Regulations 5 and 6 of the SRA Practising Regulations 2009, subject to the conditions that:
i) He may act as a solicitor only in employment which has first been approved by the Solicitors Regulation Authority.
ii) He is not a sole practitioner or a manager or an owner of a recognised body.
iii) In this condition “manager” is as defined in Section 207 of the Legal Services Act 2007 and “owner” is as defined in rule 24 of the Solicitors’ Code of Conduct.
iv) He does not hold or have responsibility for any client money and does not authorise client or office account transfers, electronic or otherwise.
v) He is not a signatory to any client or office account cheques.
vi) He attends a course accredited by the Solicitors Regulation Authority on the Solicitors Accounts Rules 1998 within 4 months of the date of notification of this decision and provides confirmation of his attendance (in the form of a certificate or letter of attendance from the course provider) on such course within 6 months of notification of this decision.
vii) Mr Boakye-Yiadom shall immediately inform any actual or prospective employer of these conditions and the reasons for their imposition.

In imposing these conditions, the Adjudicator had regard to Regulation 6.1(a), (d) and (f) of SRA Practising Regulations 2009.

Decision details
To grant Mr Kwasi Baokye-Yiadom a practising certificate for the practice year 2010/2011subject to the conditions that;
(1) he may act as a solicitor in partnership or as a manager or owner of a recognised body only where the arrangements have first been approved by the SRA;
(2) he is not a sole practitioner or sole director of recognised body; and
(3) he shall immediately inform any actual or potential partner, co-manager or co-owner of these conditions and the reasons for their imposition.
Reasons/basis
The SRA considers that Mr Boakye-Yiadom is unsuitable to practise as a sole practitioner because in that role he alone would be responsible for running and managing the business providing legal services and for ensuring compliance with all the rules and regulations of conduct.
The condition imposed will in the public interest prevent his practising in that position. The professional difficulties Mr Boakye-Yiadom found himself in arose when he was in partnership. In the circumstances the SRA considered it is in the public interest for the SRA to have an opportunity to consider any proposed practising arrangements where it is envisaged that Mr Boakye-Yiadom will be practising as a principal and give its consent to those arrangements.
The SRA was satisfied that the conditions imposed are necessary in the public interest and are reasonable and proportionate.
