Pursuant to the provisions of Section 13A of the Solicitors Act 1974 (as amended) and Regulation 6.1 of the SRA Practising Regulations 2009, the Adjudicator decided to impose immediate conditions upon the current practising certificate of Mr Scott Michael Bowen for the time being in force (namely for the practice year 2009/2010) that he deliver half yearly accountant’s reports, such reports and any cease to hold report required, to be delivered within 2 months of the end of the period to which they relate.
Reasons/basis
The purposes for which conditions may be imposed on a practising certificate in the public interest are set out in Regulation 6 of the SRA Practising Regulations 2009.
The Adjudicator has taken into account the representations made on the partners’ behalf by Morgan Cole LLP. Noting that the firm was awarded Lexcel accreditation in November 2009, the Adjudicator decided that it is not necessary in the public interest to require the partners to undertake training as a condition on their practising certificates (as recommended by the caseworker). It is unlikely that the firm would have been awarded accreditation had it not been able to demonstrate that it was conducting an efficient practice (Regulation 6.1 (d)).
However, it remains necessary in the public interest for the SRA to be able to monitor more closely the partners’ future compliance with the Solicitors Accounts Rules 1998 until such time that they can demonstrate full compliance over a period of at least 12 months with those Rules (Regulation 6.1 (e).
