(ii) She is not a sole practitioner, sole director , manager or an owner of a recognised body, licensed or Legal Service Body.

(iii) In this condition "manager" and "owner" are as defined in the SRA Handbook Glossary 2012.

(iv) She does not hold or have responsibility for any client money and does not authorise client or office account transfers, electronic or otherwise.

(v) She is not a signatory to any client or office account cheques.

(vi) Ms Newell-Austin shall immediately inform any actual or prospective employer of these conditions and the reasons for their imposition.

These conditions are imposed having regard to the purposes set out in Regulation 7 of the SRA Practising Regulations 2011 and to the regulatory objectives contained in the Legal Services Act 2007 and the principles governing regulatory activities in section 28 of that Act.

Reasons/basis

This notification relates to a Decision to prosecute before the Solicitors Disciplinary Tribunal. This is an independent Tribunal which will reach its own decision after considering all the evidence, including any evidence put forward by the Solicitor. The Tribunal has certified that there is a case to answer in respect of allegations which are or include that :

  • 1. She permitted or allowed the firm to become involved in, or acquiesced in the firm's involvement in, conveyancing transactions that bore the hallmarks of mortgage fraud (including failures to redeem mortgages and/or identity fraud).
  • 2. She failed to carry out her role in the business effectively and in accordance with proper governance and sound financial and risk management principles, and in particular:
    • 2.1. she failed to exercise appropriate supervision over the practice and/or over unadmitted members of staff employed by and/or working with the firm; and
    • 2.2. she permitted or acquiesced in or failed to prevent improper withdrawals from client account.
  • 3. She failed to comply with undertakings to redeem mortgages.
  • 4. She misled the SRA by failing to provide it with accurate information to enable it to make a decision on her application to obtain authorisation for the partnership.

The allegations are subject to a Hearing before the Solicitors Disciplinary Tribunal and are as yet unproven.
