Decision details

To grant Mr Miles Roderick Cox a practising certificate for the practice year 2010/2011 subject to the following conditions: that within 3 months from the date of the letter notifying him of this decision

  • 1.

    he may act as solicitor only:

    • 1.1

      in employment or partnership, or

    • 1.2

      as a manager or owner of a recognised body,

    the arrangements for which have first been approved by the Solicitors Regulation Authority.

  • 2.

    Mr Cox shall immediately inform any actual or prospective employer, partner, co-manager or co-owner of these conditions and the reasons for their imposition.

  • 3.

    In this condition, "manager" is as defined in Section 207 of the Legal Services Act 2007 and "owner" is as defined in Rule 24 of the Solicitors Code of Conduct 2007.

  • 4.

    Mr Cox undertake two courses (minimum of 3 CPD Hours each) on the Solicitors Accounts Rules 1998 and new SRA Handbook (replacing the Solicitors Code of Conduct) approved by the Solicitors Regulation Authority within 6 months of the date of notification of this decision and shall provide confirmation of his attendance (in the form of a certificate or letter of attendance) when he next applies for a practising certificate.

Reasons/basis

The SRA have considered the conditions imposed in accordance with Regulation 6.1(c) of the SRA Practising Regulations 2009, namely, that imposing the above conditions requiring Mr Cox to obtain the SRA's written approval before taking certain steps will, in the public interest, limit, halt or prevent a risk to clients, third parties or the public.
